Constitution
This was the constitution of the organisation up to its termination. I am still proud of this, because here lived democracy and freedom - unfortunately exactly the things, dancers and teachers are not interested in.
§ 1 Name and seat of the organisation
  1. The name of the organisation is: "Irish Dancing Net".
  2. The official abbreviation for the organisation is "IDN".
  3. The organisation is based in Merseburg, Germany.
§ 2 Purpose and tasks of the organisation
  1. Purpose of the organisation is the cultivation, spreading and promotion of Irish dancing and other elements of Celtic culture.
  2. Co-operation with other associations working for Celtic culture is aspired.
  3. The tasks of the organisation are as follows:
    1. Spreading of Irish dancing by supporting Irish dance groups and schools as well as Irish dance competitions and events and organising training courses concerning Irish dancing as well as Celtic history, culture and language;
    2. Maintaining a system of dancer graduations and group head and adjudicator certifications in order to safeguard and promote the quality of Irish dancing;
    3. Providing a platform for contact and communication for dancers, group heads, adjudicators, musicians and other interested persons at dance competitions, dance events, meetings and on the internet;
    4. Spreading of Irish dancing in connection with other elements of Celtic culture as a means of formation of character and health care. The main focus is especially put on the youth work.
    5. Co-operation with organisations, communities, groups and persons working in the field of Irish dancing and with other institutions, organisations and communities, which could contribute to the realisation of the tasks of the organisation, is aspired.
§ 3 Activity of the organisation
  1. The organisation fulfils its tasks by
    1. Fixing scientifically founded standards;
    2. Registering group heads, adjudicators, féilte and feiseanna;
    3. Organising oireachtais, from regional championships up to world championships, and awarding championship titles;
    4. Providing and maintaining an internet database and internet forum.
§ 4 Legal status
  1. The organisation works as a society without legal capacity according to German law. It is a non-governmental organisation (NGO).
  2. In case of doubt the German version of official documents of the organisation is legally binding.
  3. According to necessity branches in other countries may adopt other legal forms on the basis of the respective laws in force. The legal status of a branch must correspond to the constitution of the organisation.
§ 5 Charity
  1. The organisation pursues exclusively and directly charitable purposes in the sense of the paragraph "Tax-privileged purposes" of the tax law.
  2. The organisation acts selflessly. Economic viability is not the first priority.
  3. Funds of the organisation may only be used for purposes according to the constitution.
  4. Members do not obtain financial contributions from funds of the organisation.
  5. No person is allowed to benefit from expenditure foreign to the purpose of the organisation or from unusually high reimbursement.
§ 6 Financial year
  1. Financial year of the organisation is the calendar year.
§ 7 Joining of members
  1. Every natural person on reaching the age of eight may become a member of the organisation.
  2. Membership is established by joining the organisation.
  3. The declaration of joining must be presented in writing or electronically. Form and content are decided by the secretariat.
  4. The secretariat decides the admission. The decision-making powers may be transferred to executive committees of branches. Joining will become valid by transmission of a declaration of admission in writing or electronically.
  5. Rejection of admission by the secretariat or an executive committee of a branch may be withdrawn by the general meeting concerned.
  6. There is no right to be admitted.
§ 8 Resignation of members
  1. Members are entitled to resign from the organisation.
  2. There are no deadlines for resignation.
  3. Resignation must be declared to the secretariat in writing or electronically.
§ 9 Expulsion of members
  1. Members may be expelled from the organisation.
  2. If a member has considerably violated the interests of the organisation, the secretariat or the general meeting of all members or general meetings of the branches concerned may decide to expel this member from the organisation.
  3. The member in question has the right to make a statement about the matter before the decision about an expulsion is met.
  4. The decision about the expulsion must be given the grounds for in writing and must be transmitted to the member by mail or electronically.
  5. The member may appeal within a period of one month in writing at the secretariat. Appeal against expulsion by the general meeting of all members is not possible.
  6. For decisions by the secretariat and by executive committees the general meeting concerned decides the appeal, for decisions by general meetings the next higher general meeting decides.
  7. If the member refrains from appealing within this period, the expulsion is regarded as accepted.
§ 10 Cancellation of membership
  1. A membership may be cancelled.
  2. Cancellation of membership occurs if a member hasn't shown any activity within the organisation for at least one year and is obviously not interested in the membership in the organisation any more.
  3. Before a cancellation the member must be informed about the measure in progress in writing or electronically, unless there is no means of contact.
  4. Cancellation of a membership is done by decision of the secretariat, which the respective member is informed about.
  5. The member may appeal within a period of one month in writing at the secretariat.
  6. The general meeting of the lowest branch concerned decides the appeal.
  7. If the member refrains from appealing within this period, the cancellation is regarded as accepted.
§ 11 Types of membership and membership fee
  1. Membership in the organisation is possible as
    1. basic member;
    2. group head;
    3. adjudicator;
    4. founding member;
    5. honorary member.
  2. The status as group head is given to all members who hold an IDN teaching certificate as well as all members who hold a teaching certificate of another accepted traditional Irish dancing organisation or who have passed partial examinations there. The secretariat decides about the acceptance of certificates of other organisations.
  3. The status as adjudicator is given to all members who hold an IDN adjudicator certificate as well as all members who hold an adjudicator certificate of another accepted traditional Irish dancing organisation or who have passed partial examinations there. The secretariat decides about the acceptance of certificates of other organisations.
  4. A member can hold more than one status.
  5. There is no regular membership fee.
  6. The general meeting of all members may resolve the charging of single membership fees for a specified purpose. Only members who have not explicitly opposed the decision are obliged to pay.
  7. There is no enrolment fee.
§ 12 Organs of the organisation
  1. Organs of the organisation are the secretariat (§ 13 of the constitution) and the general meeting of all members (§ 15 to § 19 of the constitution).
  2. The organisation may resolve the foundation of territorial branches. Organs of a branch are executive committee and general meeting.
  3. The organisation may establish additional commissions and working groups for special purposes.
§ 13 The secretariat
  1. The secretariat comprises the secretary, the treasurer and the transcript writer. Further members may be appointed if necessary.
  2. Each member of the secretariat possesses individual power of attorney, such that each single one of them is authorised to represent the organisation legally.
  3. The secretariat is appointed by decision of the general meeting of all members for a period of two business years. The general meeting of all members may elect a new secretariat any time.
  4. The post of a member of the secretariat ends with their leaving the organisation.
  5. If a member of the secretariat leaves within the term of office, the general meeting of all members may elect a substitute member for the remainder of the term of the former member of the secretariat .
  6. Several posts of the secretariat can be united within one person.
  7. Only members who belong to the organisation at least for 24 months are eligible for election. This limitation does not exist for founding members.
  8. The secretariat administers the work of the organisation, manages the database and publishes all information relevant to the public.
  9. Branches of the organisation decide the composition, the way of appointment and the tasks of their executive committees by themselves.
§ 14 Rights and obligations of the members
  1. All members are eligible to enter petitions to the secretariat and to executive committees and general meetings of branches which are responsible for them.
  2. Members of the organisation are obliged to avoid damage to the organisation.
§ 15 Eligibility for participation in and voting at the general meeting
  1. All members are eligible to participate in the general meeting of all members of the organisation.
  2. All members of a branch of the organisation are eligible to participate in the general meeting of that branch.
  3. All basic members, group heads, adjudicators and founding members have one vote each. Does a member hold more than one status, only the highest status in this order counts for voting.
§ 16 Conference of the general meeting
  1. The general meeting of all members is permanently in session on the internet.
  2. The secretariat must provide the server-sided technical prevailing conditions to enable the members to participate in the general meeting of all members.
  3. The members must provide the client-sided technical prevailing conditions if they want to participate in the general meeting of all members.
  4. The general meetings of branches are analogously organised under the direction of the executive committee in charge.
  5. Alternatively branches may decide for rules of their own for summoning and holding general meetings.
§ 17 Presence of a quorum
  1. The general meeting of all members has permanently got a quorum. This also goes for the decision about the termination of the organisation (§ 41 BGB).
  2. In order to safeguard the quorum, each ballot must be kept open on the internet at least for two weeks.
  3. Members are responsible by themselves to inform themselves about ongoing ballots.
  4. The presence of a quorum of the general meetings of branches is made analogously.
  5. Alternatively branches may decide for rules of their own for the presence of a quorum of their general meetings.
§ 18 Resolution
  1. Ballot in the general meeting of all members is done by voting on the internet forum.
  2. The votes are recorded by person, in order to be able to check the voting process for correctness.
  3. At the ballot the simple majority of the participating members decides.
  4. For a resolution including a change of the rules about difficulty and performance levels, graduation, certification, competitions and adjudication, an absolute majority of all participating members, a majority of two thirds of the participating group heads and adjudicators and approval by all participating founding members are required.
  5. For a resolution including a change of the constitution a majority of three fourths of the participating members and approval by all participating founding members are required.
  6. In order to change the purpose of the organisation according to § 2 of the constitution approval by all participating members is required.
  7. For a resolution concerning the termination of the organisation (§ 41 BGB) a majority of four fifths of all participating members and approval by all participating founding members are required.
  8. The organisation of ballots of general meetings of branches is done analogously to clauses (1) to (3).
  9. Alternatively branches may decide for rules of their own for the organisation of ballots of general meetings.
§ 19 Documentation of resolutions
  1. The discussion of the general meeting of all members about drafts and the resulting resolutions are to be archived.
  2. Every member is entitled to see the archives.
  3. In order to safeguard the right of information of the members, results of a vote and resolutions must be made public on the internet for at least two weeks.
  4. Branches of the organisation decide themselves about the kind of documentation of their resolutions.
§ 20 Incurrence of debts
  1. To incur financial debts to the organisation is permissible by explicit approval by the general meeting of all members only.
  2. For these debts all members, who agreed or who didn't participate in the ballot, are liable personally and in equal proportions. This also continues in the event of leaving the organisation. Members, who voted against or abstained or didn't belong to the organisation at the time of voting, are not liable for such debts.
  3. Members, especially members of the secretariat, who culpably incur debts to the organisation without the approval by the general meeting of all members, are liable for these debts with their private fortune.
  4. For debts resulting from the existence or the regular function of the organisation the organisation as a whole is liable.
§ 21 Voluntary commitment
  1. Members of the organisation, who publish own choreographies in any form, make them available to the public for free further use free of charge.
  2. However, if the commercial purposes of the use of a choreography exceeds the function of a tool for an independent service of the user in order to earn a simple living, such that considerable financial profit is made out of the choreography, the ordinary copyright laws apply.
  3. Group heads of the organisation allow their dancers free choice of group, school and teacher. This includes simultaneous utilisation as well as transfer.
§ 22 Standardisation
  1. In order to define a general standard
    1. for the characterisation of the stylistics, the rhythms, and the technique of Irish dancing,
    2. for the denomination of technical elements,
    3. for the approval of dances as traditional, and
    4. for the approval of open solo sets for competitions
    the latest edition of the book "Irish Dancing" in for volumes is used.
  2. This standard is the basis for the graduation and certification examinations, and for all official statements of the organisation.
  3. In the interest of the authenticity of Irish dancing and of scientific rigour all group heads are recommended to impart this standard to the members of their groups.
  4. In the interest of general comprehensibility of dance terms all members are recommended to use the technical terminology given by this standard.
§ 23 Obligation of secrecy - treatment of organisation documents
  1. Members are obliged to maintain strict silence about all confidential matters and things they come to know as a result of their membership, especially all personal data of other members not open to the public.
  2. In the case of ending one's membership according to § 7 to § 9 the member must give back all documents provided free of charge to the organisation without being asked. The same goes for all documents of the organisation, copies, cash books, card files, member lists, etc., as well as all other records, documents and objects provided by or concerning the organisation.
§ 24 Announcements
  1. Members must immediately announce, in writing or electronically, all facts and changes relevant for membership or for supplying of services or payments, especially change of name and address and change of particulars of one's bank account (insofar as payments to the organisation are realised by debiting), to the organisation, represented by the secretariat or an executive committee of a branch.
  2. Expenses to the organisation resulting from non-observance of the obligation to inform are charged to the member concerned.
§ 25 Termination of the organisation
  1. The organisation can be terminated by decision of the general meeting of all members according to § 18 clause 7.
  2. The liquidation is executed by the secretariat.
  3. In the case of the termination or cancellation of the organisation or the ending of its present purpose the fortune of the organisation goes to the Republic of Ireland, who must use it directly and exclusively for promoting Irish culture.
Remarks concerning the system of rules: The following conventions are part of the founding agreement:
  • Correcting spelling, formulation and translation mistakes is no change of rules and may be done by the secretariat without consultation.
  • Adapting the rules concerning allowed motions and the number/acceptance of traditional dances to the state of the book "Irish Dancing" is in accordance with the constitution, thus it is no change of rules and may be done by the secretariat without consultation.
  • Tec Dian is appointed expert according to "certification" clause 25 of the certification rules.

Freedom of access
IDN competitions are open to all, independent of school and organisation membership.
Freedom of choice
IDN group heads allow their dancers free choice of teacher and renounce transfer rules.
Freedom of usage
IDN choreographies are allowed to be used freely, in so far as the purpose is not predominantly financial gain. Dance is free!
Authenticity
The IDN view on dancing is based on the entire Irish dancing tradition. Modern mixing with other dance forms is regarded as legitimate; however it is strictly distinguished from traditional Irish dance.
Scientific rigour
The IDN standards for dance, examinations and competitions are based on historical facts and scientific analysis.
